The Department of Homeland Security recently made minor revisions to the I-9 form. Specifically, the list of acceptable documents under "List A" of the I-9 form has changed. The revised I-9 form reflects these changes. Notably, five documents are no longer listed under "List A" as acceptable proof of identity and employment eligibility: (i) Certificate of U.S. Citizenship (Form N-560 or N-561); (ii) Certificate of Naturalization (Form N-550 or N 570); (iii) Alien Registration Receipt (Form I-151, though Form I-551 remains acceptable); (iv) Unexpired Reentry Permit (Form I 327); and (v) Unexpired Refugee Travel Document (Form I-571). The Unexpired Employment Authorization Document Form I-766 has been added to "List A" as an acceptable document. The instructions regarding completion of Section 1 of the I-9 form also include some minor changes.
Although compliance with the new I-9 form and corresponding procedures is not yet required, we recommend that employers require new hires to produce documents listed as acceptable on the new I-9 form.
